How a Chapter 7 case generally unfolds

Chapter 7 is a relatively short process designed to discharge qualifying debts. The sequence below is general — actual timing and requirements vary by court and by your case.

General sequence, not a guarantee

Nothing here promises that a particular asset is protected or that a particular debt will be discharged. Exemptions, dischargeability, and trustee practice all depend on the facts and your jurisdiction.
  1. Within 180 days before filing, you must complete a credit counseling course from an approved agency and file the certificate. This is a short course, often completed online or by phone.

Keeping a car with a loan

In Chapter 7 you generally cannot keep a financed car without continuing to pay. You may reaffirm the loan (agree to remain liable), redeem it (pay its current value in a lump sum), or surrender it. Reaffirmation means the debt survives bankruptcy — if you later default, the lender can still collect.

Debts that may remain

Even with a discharge, some debts commonly survive: most student loans, recent income taxes, domestic support obligations, and debts from fraud or willful injury. Whether a particular debt is dischargeable depends on the facts.

Exemptions and your property

Exemptions protect property from the trustee. Many Chapter 7 debtors keep all of their property because it is exempt, but this depends on your state's exemption law and your equity. An asset is never guaranteed protected without a full review.
